4. NUMBER OF PETITIONS REQUIRED: Each adult petitioner or emancipated child filing for a name change on his or her own behalf
must submit a separate set of documents and a separate filing fee. (Ex. Husband and wife each require a separate petition). A separate
case number will be assigned to each adult. One adult may file on his or her own behalf and also include one or more minor children on
the petition. (Ex. Mother may file on behalf of herself and her four children on the same petition). Attachment to Petition for Name
Change, form NC-110 must be completed and attached to the petition for each person whose name is to be changed.
5. NAME/ADDRESS: If the petitioner is not represented by an attorney, the petitioner’s name, address and telephone number must be
typed or printed legibly in the upper left corner of each document.
6. CAPTIONS: Examples of the caption and first line of each document (where the present name(s) are to be used) are listed in the table

7. SIGNATURES: The petition must be signed by each adult who is applying for a change of name, using that person’s present legal name.
If the petition requests the change of a minor child’s name, the petition must be signed by one of the parents, if living, or if both are
deceased, then by the guardian; and if there is no guardian, then by some relative or friend If a guardian or someone other than a parent is
signing on behalf of the minor, be sure to attach Supplemental Attachment to Petition for Name Change (Declaration of Guardian), form
NC-110G to the petition.
8. HEARING DATES/ATTENDANCE: The name change calendar is heard every Tuesday, Wednesday and Thursday at 8:30 am in the
Civil Clerk’s Office at Central Justice Center (Room D100). All adult petitioners and minors 12 years of age and older, must attend.
9. PUBLICATION OF ORDER TO SHOW CAUSE: A copy of the filed Order to Show Cause for Change of Name (Judicial Council
form NC-120) must be published in an adjudicated Orange County newspaper pursuant to California Government Code Section 6064
(publication once a week for four successive weeks) and must include all language on the form. A list of adjudicated newspapers is
available at the end of this packet. Select one and write or type its name on line 3a of the Order to Show Cause form. Cost of publication
varies depending on the newspaper selected. Proofs of newspaper publications, proofs of service on non-petitioning parents should be
filed with the court as soon as possible. Failure to submit proof of service may result in your hearing being continued.
10. CONTINUANCE: The hearing will only be continued one time without an appearance. After that, the petition and counsel (if
represented by counsel) must attend and show good cause for additional continuances, or the, matter will be dismissed.
11. DECREE: On the date of the hearing the Decree Changing Name, form NC- 130, which you have provided, will be signed and filed if
your matter is approved by the Court. Certified copies of the decree may be purchased after your hearing for a fee.

ADDITIONAL INFORMATION CHANGE OF NAME FOR
MINOR CHILD WHEN ONLY ONE PARENT PETITIONS
If only one parent petitions to change a child’s name, item 6e of form NC-110, Attachment to Petition for Change of Name must be completed
to state the name and address (if known) of the other parent (also known as a non-petitioning parent). If the non-petitioning parent resides
outside of California, the parent must be served with a copy of the Order to Show Cause by either personal service or by first-class mail,
postage prepaid requiring return receipt. The non-petitioning parent in the State of California must be personally served thirty (30) days or
more before the hearing. If notice is served by mail on the out of state non-petitioning parent, it must be mailed forty (40) days or more before
the hearing. Mailed notices may only be used if the non-petitioning parent resides outside of California. Service must be completed by a
person who is at least 18 years of age and not a party to the action. The person who served the documents must complete and sign the proof of
service.
If the location of the non-petitioning parent is unknown, he/she must be served by publishing the Notice of Hearing to Non-Petitioning Parent,
local form L-937. An application for order for publication (accompanied by a declaration of diligent search) and proposed order for
publication may be submitted to the court when the petition is filed or as soon as possible afterward. You may draft your own documents or
use packet L-0316 Name Change Publication of Notice of Hearing to Non-Petitioning Parent Booklet available on the court’s website:

NOTE: if the non-petitioning parent is not properly served before the scheduled hearing date, the petition cannot be granted and the matter will
go off calendar unless continued by the court. If continued, the non-petitioning parent must be served with an amended Order to Show Cause
or a newly completed Notice of Hearing to Non-Petitioning Parent which states the time, date and place of the continued hearing.

In most cases, a copy of the Order to Show Cause must be published in a local newspaper of general circulation once a week for at
least four consecutive weeks before the date of the hearing. You must select the newspaper from among those newspapers
legally qualified to publish orders and notices. The newspaper used must file a Proof of Publication with the superior court before
the hearing. If no newspaper of general circulation is published in the county, the court may order the Order to Show Cause to be
posted by the clerk. But you do not have to publish the order if you are seeking to change a name to conform to your gender
identity or are a participant in (1) the State Witness Program, or (2) the address confidentiality program, and the petition alleges that
you are petitioning (a) to avoid domestic violence, (b) to avoid stalking, (c) to avoid sexual assault, or (d) to avoid human trafficking.

The petition for change of name must be filed in the superior court of the county where the person whose name is to be changed is
a resident.
The petition may be used to change your own name and, under certain circumstances, the names of others (e.g., children under 18
years of age).
Prepare an original and two copies of each of the following documents:
In addition, a guardian must prepare and attach a Declaration of Guardian (Supplemental Attachment to Petition) (form NC-110G)
for each child whose name is to be changed.
Prepare an original Civil Case Cover Sheet (form CM-010). File the original petition and Civil Case Cover Sheet with the clerk of
the court and obtain two filed-endorsed copies of the petition. A filing fee will be charged unless you qualify for a fee waiver. (If you
want to apply for a fee waiver, see Request to Waive Court Fees (form FW-001) and Information Sheet on Waiver of Court Fees
and Costs (form FW-001-INFO). There is no filing fee for minors in the State's address confidentiality program (Safe at Home).

You should request a date for the hearing on the Order to Show Cause for Change of Name (form NC-120) at least six weeks in the
future. Take the completed form to the clerk's office. The clerk will provide the hearing date and location, obtain the judicial officer's
signature, file the original, and give you a copy.
If you are changing your name to conform to gender identity, you need not request a hearing date. Instead, complete the Order to
Show Cause for Change of Name to Conform to Gender Identity (form NC-125) and take the completed form to the clerk's office.
The clerk will obtain the judicial officer's signature, file the original, and give you a copy.

If you are a person in county jail, or under the jurisdiction of the Department of Corrections and Rehabilitation (in state prison, or on
parole) you may file a petition to change your name, but must serve the petition on a government agency.
8. Name Change for Children
If the nonconsenting parent resides in California, the order or notice must be personally served on the nonconsenting parent.
You cannot personally serve this document.
If the nonconsenting parent resides outside California, that parent may be served by sending a copy of the order or notice by
first-class mail, postage prepaid, return receipt requested.
If you have served a parent or grandparent, file a copy of the completed Proof of Service of Order to Show Cause (form NC-121)
with the court before the hearing.

Local courts may supplement these instructions. Check with the court to determine whether supplemental information is available.
For instance, the court may provide you with additional written information identifying the department that handles name change
petitions, the times when petitions are heard, and the newspapers that may be used to publish the Order to Show Cause.

If you are a petitioning parent requesting the name change for a child under 18 years of age, and one of the parents, if living,
does not join in consenting to the name change, the petitioning parent must have a copy of the Order to Show Cause or notice
of the time and place of the hearing served on the nonconsenting parent. Service must be made at least 30 days prior to the
hearing, under Code of Civil Procedure sections 413.10, 414.10, 415.10, or 415.40.

If you are the guardian of a minor and filing a petition to change the name of that minor, you must (1) provide notice of the
hearing to any living parent of the child by personal service at least 30 days before the hearing (or as in b above), or (2) if either
or both parents are deceased or cannot be located, serve notice of the hearing on the child's grandparents, if living, not less
than 30 days before the hearing, under Code of Civil Procedure sections 413.10, 414.10, 415.10, or 415.40. (If the minor's name
is being changed to conform to gender identity, these notices and orders for grandparents need not be completed or served.)

If no written objection is filed at least two court days before the scheduled hearing, the court may grant the petition and sign the
decree without a hearing. Check with the court to find out if a hearing will be held. If there is a hearing, bring copies of all
documents to the hearing. If the judge grants the petition, the judge will sign the original decree.
If you filed a petition for name change to conform to gender identity, and timely objections were filed, the court may set a hearing
date after receiving the objections. If it does, you will be sent a notice of the hearing date. Check with the court after the deadline for
filing objections to see if a hearing date has been set. If there are no objections, the court will grant the petition and sign the decree
without a hearing.

To Plaintiffs and Others Filing First Papers. If you are filing a first paper (for example, a complaint) in a civil case, you must
complete and file, along with your first paper, the Civil Case Cover Sheet contained on page 1. This information will be used to compile
statistics about the types and numbers of cases filed. You must complete items 1 through 6 on the sheet. In item 1, you must check
one box for the case type that best describes the case. If the case fits both a general and a more specific type of case listed in item 1,
check the more specific one. If the case has multiple causes of action, check the box that best indicates the primary cause of action.
To assist you in completing the sheet, examples of the cases that belong under each case type in item 1 are provided below. A cover
sheet must be filed only with your initial paper. Failure to file a cover sheet with the first paper filed in a civil case may subject a party,
